NOTICE OF INTENT

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i) and on behalf of the Tennessee Valley Healthcare System (TVHS), Network Contracting Office (NCO) 9 intends to negotiate on a sole source basis with Ethicon US, LLC., doing business as (DBA) Advanced Sterilization Products Division (ASPD), located at 33 Technology Drive Irvine, CA 92618-2346. The rationale basis for the sole source acquisition is that ASPD is the only responsible source that can provide maintenance support and original equipment manufacturer (OEM) parts for designated government-owned ASPD sterilization systems. This acquisition is anticipated to take place on or about April 1, 2019. The period of performance will be for twelve months from contract award.

The intended procurement will be classified under North America Industry Classification System (NAICS) 811219 with a small business size standard of 1000 employees. This notice of intent is not a request for offers. However, all responsible sources may submit a capabilities statement, in addition to a letter directly from ASPD confirming the ability to perform this requirement, that proves by the preponderance of the evidence that the current warranty provided by ASPD, for the currently installed sterilizers, will not be voided by having a contractor other than ASPD conduct the above referenced maintenance.

The letter from the manufacture shall state that the contractor is an Original Equipment Manufacturer (OEM) authorized dealer, authorized distributor or authorized reseller for the proposed equipment/system such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. The maintenance shall be provided by original equipment manufacturer (OEM)-certified technicians and shall use only OEM-approved replacement parts and proprietary software.

All capability statements received by the closing date of this synopsis will be considered by the government. A determination by the government not to compete based on responses to this notice is solely within the discretion of the government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.

Capability statements shall be submitted by email only as a MS Word or Adobe PDF attachment to Stephen A. Clabough at stephen.clabough@va.gov. Capability statements are due not later than 0700 CT on 29 March 2019.
