Sources Sought for Fort Carson Prisoner Confinement Requirement
The Provost Marshall, Fort Carson, Colorado requires Military Prisoner Confinement Services for male and female military prisoners from Fort Carson. The services are to be provided whenever needed for pretrial and post trial confinement in a Criminal Justice Center Facility within close proximity to Fort Carson. Any Criminal Justice Center Facility used, must also provide facilities, personnel, supervision and resources necessary to confine military prisoners. This includes food, clothing, medical care and daily prisoner status reports. The Facility must not be located more than 25 miles from Fort Carson, and must have the ability to segregate prisoners by sex, pretrial,post trial, and from civilian detainees. This service will be needed for approximately 5,840 days based an estimate of 16 prisoners per day for 365 days. This Sources Sought Synopsis is issued for maximizing competition. PERFORMANCE WORK STATEMENT (PWS) 11 DECEMBER 2013
SECTION C-1 GENERAL INFORMATION
C-1.1. SCOPE OF WORK The contractor shall provide all facilities, resources except those provided by the Government as specified in paragraph C.3), management and supervision necessary to feed and house military prisoners from Ft Carson, Colorado.
C-1.1.1. Contractor's facility shall be located within 25 miles (one way) from the Directorate of Emergency
C-1.1.2. The Government estimates there will be an average of 20 to 40 prisoners in confinement at any given time. Averages are derived from historical data and may or may not accurately reflect the actual numbers of prisoners housed in the contractor's facility.
SECTION C-2 DEFINITIONS
C-2.1. DAY: A twenty-four-(24) hour period commencing at 12:00:01 A.M.
C-2.2. PRISONER DAY: Each 24 hour period (or portion thereof) a Fort Carson Prisoner is housed in the contractor's facility.
C-2.3. DES: DIRECTORATE OF EMERGENCY SERVICES: The Government entity responsible for the transportation of prisoners.
C-2.4. MP/DA POLICE OFFICER: Military Police: A soldier, usually enlisted / DA POLICE OFFICER: Department of the Army Civilian law enforcement Officer. Both work for DES.
C-2.5. COUNSEL: Includes all members of the Staff Judge Advocate Corps (Trial Counsel or Defense Counsel)and Civilian Defense counsel.
C-2-6. IPMO: INSTALLATION PROVOST MARSHAL OFFICE: Military Police Station
C-2-7.PM: PROVOST MARSHAL: Senior Law Enforcement Officer/Chief of Police
SECTION C-3 GOVERNMENT-FURNISHED PROPERTY AND SERVICES
C-3.1. The Government will indicate the prisoner's status (pre-trial or post-trial) on a confinement order (DD Form 2707) accompanying the prisoner to the contractor's facility.
C-3.2. The Government does not plan to provide any supplies; however, the Government reserves the right to furnish all or part of the supplies, at any time during the life of this contract, if it is in the best interest of the
Government.
C-3.3. The Government will furnish all transportation (24 hours per day) to and from contractor's facility. The Government shall provide sufficient personnel and equipment to accommodate all transportation for the service member. The Government will be held responsible for prisoners while in the custody of the IPMO or
designated representative.
C-3.4. The Government will conduct announced and unannounced inspections of the facility at any time.Remedies to any deficiencies noted during the inspections shall be in accordance with the inspection of services clause contained in contract. Inspections shall address the general condition of the facility, i.e. cleanliness,prisoner condition, etc. Inspection shall be performed in accordance with standards set by U.S. Department of Justice detention standards and minimum conditions.
C-3.5. The Government will communicate with the contractor on a daily basis either in person or via telephone to obtain a status report of military prisoners. Matters of concern during this reporting session will be prisoner issues
and general information regarding federal prisoners (number of prisoners, classification, i.e. pretrial and post trial,officer and enlisted, male and female, and identification of any problem areas such as discipline problems, illness,
etc.).
C-3.6. The Government will be responsible for all coordination for prisoner transfer and release.
SECTION C-4 CONTRACTOR-FURNISHED ITEMS AND SERVICES
C-4.1. The contractor shall maintain the facility in accordance with the standards for a federally approved detention facility.
C-4.2. The contractor shall furnish military prisoner's three (3) meals per day consistent with the standards the facility is required to meet in feeding its civilian prisoners and other federal prisoners.
C-4.3. The contractor shall furnish mail services for the military prisoners consistent with the standards the facility is required to meet for its civilian prisoners and other federal prisoners. The contractor shall provide a copy of this
procedure to the DES within thirty (30) days of the start date of the contract.
C-4.4. The contractor shall furnish all health and comfort items consistent with the standards provided to the civilian prisoners.
C-4.5. In emergency cases, the contractor shall obtain and/or furnish military prisoners' emergency medical care.Emergency is defined as serious illness or life threatening injury.
C-4.6. The contractor shall provide space for confidential, face-to-face meeting between prisoners and their counsel. This space shall be available to permit visitation between prisoners and their counsel in accordance with
(IAW) Paragraph C-5.6 below.
C-4.7. The contractor shall allow announced and unannounced inspections of the facility at any time.
SECTION C-5 SPECIFIC TASKS C-5.1. The contractor shall provide the standards of treatment and provide housing for the military prisoners in accordance with U.S. Department of Justice detention standards and minimum conditions.
C-5.1.1. The contractor shall ensure that their facility complies with the Department of Justice, National Prison Rape Elimination Act (PREA) Standards.
C-5.2. The contractor shall supervise and control military prisoners confined in the contractor's facility.
C-5.3. In accordance with AR 190-47, the contractor shall prohibit integrating pre-trial (detained) and post-trial (sentenced) prisoners together in the same cell or civilians for any purpose. This includes roll calls, musters,dining periods or exercise periods (if any). The contractor shall provide for the segregation of pretrial Army prisoners by officer, noncommissioned officer, and enlisted, sex, and post trial status. Precautions shall be taken to ensure that interaction between pre-trial and sentenced prisoners shall not occur. The contractor will attempt to
house all post-trial (sentenced) prisoners together when space available.
C-5.4. The contractor may designate post-trial military requiring little supervision as trustees and require these prisoners to perform trustee duties.
C-5.5. The contractor shall prohibit requiring pre-trial prisoners to perform any work other than cleaning their own cell area. Under no circumstances will pre-trial prisoners supplement the prisoner work force.
C-5.6. The contractor shall permit visitation to the following individuals in accordance with the schedule listed below:
C-5.6.1. DES/IPMO OR REPRESENTATIVE: 24 hours per day
C-5.6.2. CHAPLAIN: 24 hours per day
C-5.6.3. PRISONER COUNSEL: 24 hours per day with 30-minutes notice. The contractor shall permit prisoners to receive telephone calls from their counsel 24 hours per day. If the prisoner is not physically available to talk to counsel when counsel calls, the contractor shall: (a) make the prisoner available to return the call at the earliest opportunity, (b) provide counsel an estimated time in which counsel can expect a return call, and (c) provide direct dial phone for prisoners to return counsel's phone calls 24 hours per day. The contractor shall permit prisoner
initiated telephone calls to their counsel during normal duty hours (0730-1630 hours daily, except holidays) as allowed in military confinement facilities. All telephone calls will be made from or received in a space providing for
confidential communication between the prisoner and his counsel.
C-5.6.4. MILITARY PRISONER'S COMMANDER OR AUTHORIZED REPRESENTATIVE: During military duty hours, 0600 hours to 1800 hours, subject to the Government providing advance notice to the contractor not later than close of business on the day prior to the visit.
C-5.6.5. MILITARY PRISONER'S IMMEDIATE FAMILY MEMBER: Regularly scheduled visitation days stablished by the contractor for all prisoners.
C-5.7. The contractor shall, in the event that documentation pertaining to released or transferred prisoner is received at a date after the prisoner has been released or transferred, be responsible for forwarding the documentation to the gaining facility, unit, or the prisoner's forwarding address. This action shall be completed
within three (3) days of receipt of notification.
C-5.8. The contractor shall, in the event that property belonging to a released or transferred prisoner is left at the contractor's facility (regardless of reason), be responsible for forwarding all prisoner property to the gaining facility,
unit, or the prisoner's forwarding address. This action shall be completed within (3) working days upon receipt of notification.
C-5.9. The contractor shall provide the Installation Provost Marshal Office (IPMO) 7227 Christie St. BLDG 2700, Ft. Carson, Colorado, 80913 with the monthly statistics concerning the number of military prisoners housed during the
previous month. Each monthly report shall include name, rank, prisoner's unit, and number of days housed. These statistics shall be provided by the 5th working day of each month.
C-5.10. The contractor shall notify the IPMO immediately at (719)526-6199 upon any prisoner incident such as a medical emergency, fights or other matters concerning federal prisoners not covered elsewhere in this contract.
C-5.11 Detainee's will be incarcerated IAW AR 190-9, dated 18 Jan 207, Absentee Deserter Apprehension Program and Surrender of Military Personnel to Civilian Law Enforcement Agencies and AR 190-47, dated 15 June 2006,, The Army Corrections System.
C-5.12 Provide the Fort Carson Police Desk a status of all service members incarcerated in the El Paso County Jail during the daily 0600 hours phone call from the Desk (this includes pre & post trial, in-transit and those soldiers held for civilian charges during the past 24-hours). C-5.13 CONTRACTOR MANPOWER REPORTING. The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor shall report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. The
contractor is required to completely fill in all the information in the format using the following web address https://contractormanpower.army.pentagon.mil. The required information includes: (1) Contracting Office, Contracting Officer, Contracting Officer's Technical Representative; (2) Contract number, including task and delivery order number; (3) Beginning and ending dates covered by reporting period; (4) Contractor name, address,phone number, e-mail address, identity of contractor employee entering data; (5) Estimated direct labor hours (including sub-contractors); (6) Estimated direct labor dollars paid this reporting period (including sub-contractors); (7) Total payments (including sub-contractors); (8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each sub-contractor if different); (9) Estimated data collection cost; (10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information); (11) Location(s) where the contractor and sub-contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); (12) Presence of deployment or contingency contract language: (13) Number of contractor and sub-contractor employees deployed in theater this reporting period (by country);(14) As part of its submission, the contractor shall also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending 30 September of each government fiscal year and must be reported by 31 October of each calendar year.Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML
direct transfer is a format for transferring files from a contractor's system to the secure web site without the need for separate data entries for each required data element at the web site. The specific formats for the XML direct
