Synopsis / Notice of Proposed Sole Source: This notice is prepared in accordance with the Federal Acquisition Regulation at 5.201. The Bureau of Indian Affairs intends to solicit/ award a sole source, firm-fixed price contract under Federal Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items, to United Phosphorus, 630 Freedom Business Center, King of Prussia, PA 19406 for aquatic herbicide to be delivered to its Fort Hall Irrigation Project located in Fort Hall, Idaho. United Phosphorus is the manufacturer and sole authorized dealer /distributor of the required supplies that meet Environmental Protection Agency (EPA) aquatic herbicide to control Horned Pond Weed in irrigation / flowing water /canal applications with the required formulation of Salt of Endothall. The NAICS is 325320 and size standard 1000 employees. A brand name restriction applies to all lines on the order because the BIA/ Fort Hall Irrigation project prefers use of EPA "non-restricted use" chemicals for human health reasons and ease of application and therefore will not consider EPA "restricted use" aquatic herbicides for this requirement, and the Teton Minor product offered by United Phosphorus contains the required formulation with Salt of Endothall that is effective on Horned pond weed. A 250-gallon sized tote is required for efficiency of application. Contractors interested in this requirement may submit a quote/ response to this request in accordance with FAR Part 12 no later than November 15, 2019 at 3 pm EST. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency.

How to respond to this notice: Submit attached SF 1449 via email to: Anita.MacAuley@bia.gov with the subject line "FORT HALL IRRIGATION 0040465680" in the subject line of the email. The Government will consider all responses received submitted by the stated due date for submission of quotes; however quotes received from qualified Indian Small Business Economic Enterprises (ISBEEs) will be considered before all others per the requirements of the Buy Indian Act (1452.280-1, Notice of Indian Small Business Economic Enterprise Set-aside (JUL 2013). All interested parties are advised that no alternate sized totes will be acceptable; the 250-gallon sized tote is a firm requirement due to the government's requirement to apply the product over a large geographic area in the most efficient manner. Price shall also include pick up / disposal of totes at the end of the irrigation Season, but not later than 6 months after award. A determination by the Government not to complete this acquisition based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The following products with these specifications will be procured: (The below is a summary of the requirement only; quotes are to be submitted on the attached SF 1449 form).
