The Naval Air Systems Command (NAVAIR) intends to issue a sole source contract to the Bell-Boeing Joint Project Office, to procure Non-Recurring Engineering (NRE) for the design, development, test and evaluation, integration, and airworthiness qualification of improvements to current Auxiliary Power Unit start contactors to include procurement of production and retrofit kits in support of the V-22 aircraft.

This requirement will be procured in accordance with the statutory authority permitting other than full and open competition under Title 10 U.S.C 2304(c)(1), as implemented by FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." As the sole designer, developer, and producer of the V-22 tilt-rotor aircraft and is the only known source that possesses the engineering data, Bell Boeing is the only source that has unrestricted access to the totality of technical data needed to support the requirement herein. Further, the Government does not possess adequate license rights to the required technical data package necessary to support a competitive procurement to fulfill the requirement herein.
