The Federal Bureau of Investigation is issuing a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, supplemented with additional information in this notice in using FAR Part 13. The solicitation number is RFQ0005386 and is issued as a Request for Quote (RFQ). This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-86. The associated North American Industrial Classification System (NAICS) code for this procurement is 511210.


The Federal Bureau of Investigation intends to negotiate on a sole source basis with Evident, Inc., 739 Brooks Mill Rd, Union Hall, VA 24176-4025. The proposed contract action is for delivery of EverASM Standard Software for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested parties may identify their interest and capability to respond to the requirement by submitting a quotation to include functional specifications/descriptions and pricing. This notice of intent is not a request for competitive proposal. However, all data received within three (3) days after the date of publication of synopsis will be considered by the Government. A determination by the Government not to compete this proposed contract based upon response to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Destination- FOB. FBI specific clause - Release of Information - Publications by Contractor Personnel: The Federal of Investigation (FBI) specifically requires that Contractors shall not divulge, publish or disclose information or produce material acquired as or derived from the performance of their duties. For purposes of this Clause "Information" shall include but not be limited to: In any Media or all media including on the web or web sites; publications, studies, books, theses, photographs, film or public announcements, press releases describing any part of the subject matter of this contract or any phase of this contract or any phase of any program hereunder, except to the extent such is: 1. Already known to the Contractor prior to the commencement of the contract; and 2. Required by law, regulation, subpoena or government or judicial order to be disclosed, including the Freedom of Information Act. No release of information shall be made without the prior written consent of the Office of Public Affairs and the Contracting Officer. The Contractor and author are warned that disclosure is not without potential consequences. The FBI will make every effort to review proposed publications in a timely manner to accommodate these and other publications. These obligations do not cease upon completion of the contract. No telephone inquires will be accepted.

**Question Submission: Interested Offerors must submit any question concerning the solicitation at the earlies time possible to enable the Buyer to respond. Questions may be submitted to the attention of Rosa Perry at Rosa.Perry@ic.fbi.gov, no later than Thursday, May 25, 2017 at 11:00 AM (Eastern).


1. New Equipment only will be accepted for this procurement.
2. Quote must be valid for 30 days from closing of posting.
3. Delivery must be made within 30 days or less after Receipt of Order (ARO).


The selected offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.212.1, Instructions to Offerors-Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications-Commercial Items-the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4. Contract Terms and Conditions-Commercial Items: FAR 52-212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222.37, 52.225-13, 52.232-34. SAM Requirements:


Note: Ensure your firm is registered in System for Award Management (SAM) - All vendors must be registered in SAM, effective July 29, 2012, to receive government contracts. The FBI is utilizing a new financial system that has a direct interface with the SAM. If any current FBI vendor data conflicts with SAM Data, the information contained in SAM may override our current information. Please ensure that your company's SAM information is updated and accurate. This includes: TIN, EFT, EUNs, addresses and contact information. The EFT banking information on file in SAM will be what the FBI uses to process payment to your organization.


FBI Procurement Risk Assessment (PRA): In addition, the required piece of equipment/software is considered a critical asset. Prior to award, the intended awardee will be required to submit documentation to include Acquisition Risk Questions and a Key Personnel Listing. Once this information has been received it is anticipated that it will be 10 -20 days before the award will be made.
