Army Contracting Command - Redstone intends to procure hardware, facilities, equipment, and all technical, planning, management, manufacturing, and testing efforts to include all incidental services to produce PATRIOT Sweep 9 hardware modification kits and initial spares in accordance with (IAW) numerous approved engineering change proposals required to address the upgrades in reliability and capabilities. The PATRIOT modification kit effort includes the Antenna Support Group (ASG), Radar Weapon Control Interface Unit (RWCIU), and the Search Track Channel (STC) upgrades. The proposed contract action anticipates initial award on or before 31 March 2018 with all options exercised on or before 30 September 2020. The proposed source for the PATRIOT Sweep 9 modification kits and initial spares is Raytheon Company, 350 Lowell St., Andover, MA, CAGE Code: 05716. Raytheon Company is the designer, developer, and producer of the PATRIOT System for US and FMS customers to include the development and testing of the Sweep 9 modification kits. Considering Raytheon Company's history of research, development, and production of the PATRIOT system, any other vendor selected would currently lack the technical knowledge, manufacturing/test capability, and skill-set regarding the PATRIOT system and the interface/interoperation required for the Sweep 9 modification kits. Raytheon has already completed First Article Testing (FAT), Environmental Stress Screening (ESS), Functional Configuration Audits (FCA), Physical Configuration Audits (PCA), and Production Qualification Testing (PQT). Another vendor would have to duplicate these activities to qualify their production hardware. The statutory authority permitting Other Than Full and Open Competition is Title 10, United States Code, Section 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(ii)(A) and (B), "Only one responsible source, and no other supplies or services will satisfy agency requirements". Additionally, the Manufacturing Data Package (MDP) is owned by Raytheon Company and is proprietary. The manufacturing processes contained in the MDP are crucial to successful and timely performance of this effort. All responsible sources may submit a proposal and will receive due consideration, as required by law. As the justification for a sole source action is in accordance with FAR 6.302(a)(2)(ii) (A) and (B), the Contracting Officer will make a copy of the justification available on FedBizOpps available within 14 days after award in accordance with the requirements of FAR 6.305(a). Offerors are encouraged to contact Raytheon Company for subcontracting opportunities for this effort. This requirement is not currently fully funded; the initial award and exercise of additional options will be withheld pending receipt of sufficient funds. No telephone requests will be accepted.
