Combined Synopsis/Solicitation

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. ICE intends to award a firm-fixed-price purchase order in accordance with Simplified Acquisition Procedures under FAR Part 13.

(ii) Solicitation number 192119OPA00000011 is issued as a request for quotation (RFQ).

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2019-03, effective July 12, 2019.


(iv) This requirement is solicited as a total small business set-aside. The associated North American Industrial Classification System (NAICS) code is 519110 and the small business size standard is $27.5M.


(v) The Purchase Order will include the Contract Line Item Numbers (CLINs) listed on the attached Standard Form 18 (SF18).


(vi) ICE requires the ScreenFeed Subscription Service for digital signage including news with HD photos, weather forecasts and radar, trivia, event info and video shorts. ScreenFeed is the only company that provides this service and interfaces with the existing ICN CoolSign equipment. 


(vii) ICE anticipates the resulting Purchase Order will have a period of performance consisting of one (1) 12-month base period and four (4) 12-month option periods as 
outlined below:


Base Period: September 30, 2019 to September 29, 2020
Option Period 1: September 30, 2020 to September 29, 2021
Option Period 2: September 30, 2021 to September 29, 2022
Option Period 3: September 30, 2022 to September 29, 2023
Option Period 4: September 30, 2023 to September 29, 2024


Delivery will be FOB destination. Acceptance will be conducted as outlined in FAR 52.212-4(a).


(viii) The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Offerors shall provide pricing on the attached Standard Form (SF) 18 and submit a copy of the proposed End User License Agreement (EULA) that has been tailored to be compliant with federal procurement laws.


(ix) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Technical acceptability and price shall be used to evaluate offers. The evaluation of responses to this RFQ will be conducted solely based on the written information submitted. All quotes received in response to the RFQ will be ranked from lowest to highest based on the total evaluated price. The Government will then identify the response with the lowest price and evaluate it for technical acceptability. If this response is deemed technically acceptable, then a Purchase Order will be awarded to that Quoter. If the response is deemed technically unacceptable, then the Quoter's response with the next lowest price will be evaluated for technical acceptability. This evaluation process shall continue until a technically acceptable quote is identified. Accordingly, it is possible that a technical evaluation of some responses will not occur.

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.



(x) Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer.


(xi) The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition.


(xii) The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. Additional clauses applicable to this order are provided in Attachment B: Terms and Conditions.


(xiii) Any applicable terms and conditions are provided in Attachment B.


(xiv) The Defense Priorities and Allocations System (DPAS) is not applicable to this RFQ.


(xv) Quotes shall be submitted electronically to Michelle.Brooks@ice.dhs.gov and Miranda. Collins@ice.dhs.gov no later than 10:00am on August 26, 2019. Late submissions may not be considered.
