This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number for this requirement is 36C25919Q0058 and is hereby issued as a Request for Quote (RFQ).
The VISN 19 Rocky Mountain Acquisition Center, NCO 19, 6162 South Willow Drive, Suite 300, Greenwood Village, Colorado 80111, on behalf of the following VA (Veterans Affairs) Health Care Systems, has a contract requirement for a base period and four 1-year possible options for Regulated Medical Waste Pick-up and Disposal Services:
VA Eastern Colorado Health Care System, 1700 North Wheeling Street, Aurora, CO 80045.
VA Montana Health Care System, 3687 Veterans Drive, Fort Harrison, MT 59636.
VA Sheridan Health Care System, 1898 Fort Road, Sheridan, WY 82801.
VA Cheyenne Health Care System, 2360 East Pershing Blvd., Cheyenne, WY 82001.
The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-101 effective October 26, 2018. The North American Industry Classification System (NAICS) code is 562112 Hazardous Waste Collection, with a small business size standard of $38.5 million. This procurement will be a 100% Small-Business set-aside, with priority going to Service Disabled Veteran Owned Small Businesses (SDVOSB) and Veteran Owned Small Businesses (VOSB). The Government intends to issue a firm fixed price contract to the lowest priced, technically acceptable (LPTA) offeror. Only technically acceptable quotes will be considered. The Government intends to evaluate quotes and make award without discussions; however, this does not preclude the Government from having discussions if it is in the best interest of the Government. All interested parties must bid on all items.

1.0 INTRODUCTION
1.1 BACKGROUND
The Veterans Health Administration (VHA) is the Nation's largest integrated health care system. With a medical care appropriation of more than $47 billion, VHA employs more than 239,000 staff at over 1,400 sites, including hospitals, clinics, nursing homes, domiciliary occupancies, and Readjustment Counseling Centers. In addition, VHA is the Nation's largest provider of graduate medical education and a major contributor to medical research. The mission of the VHA is to honor America's Veterans by providing exceptional health care that improves their health and well-being.
1.2 DEFINITIONS
Medical Waste: Medical Waste as used in this Statement of Work (SOW) includes Regulated Medical Waste (RMW) and Incineration Waste (IW).

Regulated Medical Waste (RMW): The term Regulated Medical Waste as used in this SOW shall include only those wastes defined by the United States Environmental Protection Agency (USEPA) as infectious wastes in its Guide of Infectious Waste Management #EPA/530-SW-86-014, May 1986 and any other wastes identified as infectious or similar wastes in any other applicable federal, state, country or municipal laws, regulations and guidelines.

A waste that contains an infectious substance and is generated in the diagnosis, treatment, or immunization of human beings or animals; research pertaining to the diagnosis, treatment of human beings or animals and the production or testing of biological products and refers to the following categories of wastes which require special handling, at a minimum:

1. Liquid or semi-liquid blood or other potential infectious material (OPIM).
2. Items contaminated with blood or OPIM and which would release these substances in
a liquid or semi-liquid state if compressed.
3. Items that are caked with dried blood or OPIM and can release these materials during
handling
4. Contaminated sharps (stored in disposable Sharps containers)

Incineration Waste (IW): The term Incineration Waste as used in this SOW shall include Trace Chemotherapy Waste empty drug vials, syringes, spill kits, IV tubing and bags, contaminated gloves, contaminated gowns. Chemotherapy containers SHALL have less than 1 inch of fluid remains. It shall also include non-hazardous pharmaceuticals and path

2.0 SCOPE OF WORK
B The Contractor shall provide labor, transportation, collection, removal, treatment and destruction for the disposal of all Medical Waste to include Regulated Medical Waste and Incineration Waste generated by VA Montana Health Care System (VAMHCS), VA Eastern Colorado Healthcare System (ECHCS), VA Sheridan Health Care System (VASHCS), VA Cheyenne Health Care System (VACHCS) and all associated Community Based Outpatient Clinics (CBOCs) and Primary Care Telehealth Outreach Clinics (PCTOCs) as specified in this SOW and the Schedule of Services/Costs. Performance shall be according to the requirements contained in this SOW.

All work shall be accomplished in accordance with Federal, State, and local regulations. The applicable federal regulations that are included but not limited to are the following:

The Contractor shall provide the services enumerated above at the rates set forth which includes all applicable taxes, assessments, and related charges, including adjustments, fuel, and container. The Contractor shall provide all the necessary equipment to perform such services and all such equipment shall comply with all applicable federal, state, county, and municipal laws, regulations, guidelines and permits.
The Contractor shall be fully responsible for destruction and disposal of all Regulated Medical Waste and Incineration Waste generated by the facilities. All Regulated Medical Waste and Incineration Waste, residues, and absorbents etc. waste is to be destroyed in accordance with all local, state, federal and EPA laws and regulations. The Contractor shall be solely responsible for complying with all government regulation regarding the transport and disposal of Regulated Medical Waste and Incineration Waste.
Disposal of destroyed Regulated Medical Waste and Incineration Waste shall be only at an approved disposal site as required by the local and state government authority having jurisdiction.
Any medical waste to include syringes and sharps that contain protected health information labeling must be rendered unreadable.
The contractor shall be able to provide 4.3 CF (cubic feet) medium box, 18, 28, 32, 40, 48, and 55-gallon RMW containers, as well as 20 and 28-gallon IW containers (the VA may accept variations in size) with any applicable and required liners. These containers will be located in a centrally located area at each facility for all authorized VA employees to deposit disposable Sharps boxes, Red Bag bags/containers and Chemo waste bags/containers. All Contractor provided containers shall be labeled according to all federal, state and local regulations. Any changes to type, size, amount of equipment, and the frequency of service shall be mutually agreed to in writing by both parties through a modification to the contract.
NOTE. All facilities will be responsible for providing their own disposable Sharps boxes, Red Bag bags/containers, and chemo waste bags/containers. All facilities shall store their Medical Waste in the centrally located containers provided by the Contactor.

NOTE: This solicitation excludes pathological and microbiological wastes, Resource Conservation and Recovery Act (RCRA) listed hazardous wastes, pharmaceutical wastes, corrosive, reactive, radioactive, toxic, and other Regulated Medical Wastes and substances as defined in any applicable federal, state, county or municipal laws, regulations and guidelines.

The contractor shall pick-up regulated medical waste between the hours of 8:00 AM through 4:30 PM on regular clinic days. The contactor shall not pick-up medical waste outside of the designated hours. The scheduled pick-up times will be mutually agreeable to both parties. The above pick-up frequency may be changed to accommodate the needs of the clinics without modification to the contract as the number of pick-ups and containers per pick-up are both estimated quantities. The contractor shall be responsible for notifying the appropriate Government official at each site for arrangements for the pick-up of the Regulated Medical Waste. If routine pick-up is scheduled on a recognized Government holiday, then the pick-up must be rescheduled and picked-up either within three (3) days before or after the holiday. The 10 national holidays observed by the Federal Government are as follows:

3.0 PERSONNEL
Contractor employees shall not be considered or treated as federal employees for any purpose, shall not be regarded as performing a personal service, and shall not be eligible for civil service employee benefits, including retirement. Contractor employees shall identify themselves as Contractor employees in all communication modes used in performing the services, e.g. email, telephone, verbal. Services furnished by contractor employees shall be performed as necessary to fulfill the requirements of this SOW. All Contractor employees shall be trained in the proper DOT, EPA, and DEQ handling requirements.
The Contracting Officer s Representative (COR)/VA Facility Point of Contact (POC) reserves the right to request the Contractor to provide another employee if an employee does not obey VAMC directives, or does not act in the best interest of the Government.


3.1 EDUCATION AND TRAINING REQUIREMENTS.
The Contractor shall provide training to the employees at all the facilities (if required) for proper packaging of waste prior to the startup of the contract performance. The Contractor reserves the right to decline to accept for collection, transportation, treatment of disposal of any Regulated Medical Wastes that cannot be transported, treated or disposed of in a lawful manner or without a risk of harm to public health or the environment. Improperly packaged, leaking, overweight or damaged containers are subject to rejection. No containers shall be picked up that are wet or leaking. Repackaging of the waste by the Contractor will be reimbursable when prior approval of the VA representative is acquired.


4.0 SPECIAL CONTRACT REQUIREMENTS

4.1 RECORDKEEPING

In the performance of all services to be provided hereunder, the Contractor agrees to comply with all applicable permits, all applicable federal, state, county, and municipal laws and ordinances and all lawful orders, rules, regulations and guidelines of any duly constituted authority, including but not limited to social security, income tax withholding laws, unemployment compensation laws, environment, safety and health laws and manifesting requirements.

The Contractor and its affiliates shall keep and retain adequate books and records and other documentation including personnel records, correspondence, instructions, plans, receipts, vouchers, copies of all manifests and any other records or repots or memoranda, consistent with and for the period required by applicable regulatory requirements and guidelines pertaining to performance of the services.



4.2 DOCUMENTATION OF SERVICES RENDERED

The contractor shall provide a log sheet at the time of the Regulated waste pick-up. The original copy will be given to the VA Contracting Officer Representative (COR) or local on-site Point of Contact (POC). The log sheet shall state the date of pick-up, the number of boxes taken, the weight of the boxes, the signature of the contractor representative and signature of the VA COR/POC. The Contractor shall email all invoices to the individual CORs for each station.

4.3 HANDLING OF MEDICAL WASTE

4.3.1 Material Safety Data Sheets (MSDS)

The Contractor shall collect a copy of all MSDS from each facility for each individual item that is being picked-up and transported for disposal. The COR/POC will provide the contractor with the MSDS prior to the contractor leaving the station.

4.3.2 SPILL HANDLING

The Contractor shall report all spills to the facility s designated official and to the COR/POC. The contractor will be legally and financially responsible for the cost of all clean-up of spills created by the contractor. The contractor will be required to clean-up any spills created during the collection process

5.0 QUALITY CONTROL/ASSURANCE
5.1 QUALITY CONTROL.
The Contractor is responsible for ensuring services are performed in accordance with PWS requirements. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. As a minimum the contractor shall develop quality control procedures addressing the areas identified in paragraph 5, Quality Assurance Surveillance Plan.
5.1.1 DOCUMENTING PERFORMANCE.
Environmental Maintenance Service (EMS) personnel or Environmental Management (EM) personnel will verify performance of the contractor. EMS or EM personnel will contact the COR/POC of any discrepancies. The COR/POC will document any deficiencies in writing and forward them to the contracting officer.
