The US Army has a sole source requirement to procure a minimum of 82 and up to a maximum of 1,1016 Side-Facing Multi-Functional Operator Seats (SFMFOS) (NSN 1680-01-573-6384) to replace the existing MFOS (NSN 1680-01-569-8582) and Retrofit Kits (Part Number MBCS13860) for the H-60M fleet under the existing Firm Fixed Price Indefinite Delivery Indefinite Quantity contract W58RGZ-17-D-0046.

Pursuant to statutory authority of Title 10 USC 2304(c)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(ii)(A) - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" and FAR 6.302-1(a)(2)(ii)(B) - Unacceptable Delays in Fulfilling the Agency Requirements, this proposed contract action is for hardware for which the Government intends to solicit and negotiate with only one source - Martin Baker America, Inc. (MBAI), 169 Jari Drive, Johnstown, PA 15904, CAGE Code 1Q842.  MBAI is the Original Equipment Manufacturer and has exclusive ownership of all data rights required to produce, maintain, and modify the SFMFOS; therefore, a technical data package is not available.  This is not a small business set aside.  Parties interested in potential subcontracting opportunities should contact MBAI.

Any responsible source may identify its' interest by submitting a capability statement in response to this requirement.  If your organization has the capability to perform this effort, the following information shall be included in your capability statement:


•1.  Provide company information including:
•a.  Company name and address.
•b.Size of company (number of personnel, total revenue, ownership, CAGE Code, Parent Corporation, etc.).
•c.  If significant subcontracting or teaming is anticipated in order to deliver technical capability, organizations should address the administrative and management structure of such arrangements.
•d.  Point(s) of contact, including name, phone number, address, email, and length of time in business.
•e.  Geographic presence.

•2.  Provide evidence that your organization has the ability to provide SFMFOS and Retrofit Kits for the   H-60M fleet.

•3.  Provide any other pertinent information that will assist in this assessment.

 A determination by the Government not to compete this proposed contract modification based upon responses to this notice is solely within the discretion of the Government.  Any capability statement must be submitted electronically to ashley.n.gizas.civ@mail.mil and patrick.c.walker.civ@mail.mil no later than 2:00pm CST, March 21, 2019.
