Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) SubPart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; Quotes are being requested, and a written solicitation document will not be issued.
This solicitation is a request for quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular Number 2005-101; effective October 26, 2018.
The associated North American Industrial Classification System (NAICS) code for this procurement is 333415 (Air-Conditioning Equipment Manufacturing) with a small business size standard of 1,250 employees.
The Department of Veterans Affairs, Clement J. Zablocki Medical Center, 5000 W. National Ave located in Milwaukee, WI 53295 is seeking to purchase one 40 Ton capacity portable air conditioning unit (NEMA 4) capable of cooling up to 16,000 square feet of uninsulated enclosed area. Contractor to provide delivery and written documentation of all manufacturer s warranty.

Salient Characteristics required to meet the Government s needs:
NEMA 4 portable air conditioning unit, 40-ton capacity

Skid frame shall be of a galvanized weather resistant metal with lifting eyes and forklift pockets.
All cabinet components must be stainless steel.
Supply duct: unit shall have two 20inch diameter round duct openings.
Return/ outside air duct: unit shall have four 20inch diameter round duct openings.
The return/ outside air section of the unit must be equipped with a filter section.
Dimensions not to exceed, 78 L x 88 W x 98 H.
Electrical: unit must be 460V/3PH/60HZ with weather resistant cam lock connections to connect to a power source.
Unit must have dual refrigerant circuits with 2 stages of cooling, dual hot gas bypass and dual condensate connections (1 B< FPT).
All fan motors must be direct drive fans.
Any/ all condensate pans must be made of stainless steel.
High and low voltage control panels must be sealed and isolated.
Any/ all condenser coil guards must be corrosion resistant.
Controls: units shall have a main power disconnect, a master on/off switch, high static cut out, circuit #1 and #2 failure alarm, a phase failure alarm, hour meters for each refrigerant circuit and a DDC temperature controller.
All refrigerant circuits must have isolation valves, sight glasses and filter driers.

40 Ton Capacity Portable Air Conditioning Unit will be delivered to the Department of Veterans Affairs, Clement J. Zablocki Medical Center, 5000 W. National Ave, Building 111 Milwaukee, WI 53295.

Basis for Award
1. Award shall be made to the offeror whose quotation offers the lowest price technically acceptable.
2. Price reasonableness, in accordance with FAR 13.106-3, will be followed.
3. Proof of authorized distributorship must be included in the submission to the Contracting Officer. The Contracting Officer will deem the submission an un-interested party if authorized distributorship paperwork from the Original Equipment Manufacturer is not received or missing with submission.
4. This is an open-market combined synopsis/solicitation for products and services, as defined herein.B B The government intends to award a contract as a result of this combined synopsis/solicitation that will include the terms and conditions set forth herein. In accordance with FAR 12.301(b)(1) and FAR 52.212-1(b)(11), To facilitate the award process, all quotes must include a statement regarding the terms and conditions herein as follows:
"The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition."

Offeror shall list exception(s) and rationale for the exception(s).
5. The Offerors quote submitted to this CO shall also have the same line item that matches this notice, and the required statement regarding terms and conditions of contract within their quote. The Offeror may submit this same Combined Synopsis/Solicitation as their official quote, and if so, all pages are required for submission, and the vendors name and DUNS number must be placed on the last submitted sheet of this Combined Synopsis/Solicitation.

The following solicitation provisions apply to this acquisition:
FAR 52.212-1, Instructions to Offerors Commercial Items JAN 2017
(a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers.B No remanufactures or gray market items will be acceptable.
B (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM.B All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions.
(c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.B Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s) delivered to a VA medical facility upon discovery of such items.B

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov.
