Notice of Intent to Sole Source

The Naval Medical Center San Diego (NMCSD) intends to award a sole source purchase order under the authority of FAR 13.106-1(b), due to only one source being available to meet the Government's needs, to the Depuy Synthes Sales Inc., 325 Paramount Dr., Raynham, MA02767-5199. Requirement consist of four (4) Expedium Polyaxial Screws Ti, four (4) Set Screws Ti X25, one (1) Crosslink SFX, two (2) Pre-Contoured Titanium Rods, one (1) Chronos Granules, and one (1) Tap for the L4/L5 Posterior Lumbar Interbody Fusion. The Orthopedic Department requires the Depuy Expedium Pedicle Screw System for patient scheduled for surgery on 16 May 2017. This requirement is patient specific and per patient's anatomy, the pedicle screws system must have the following characteristics: 1) must have dual lead screws; 2) screws must make use of a closure system/mechanism that reduces cross threading, minimizes head spread; 3) screws must make use of polyaxial design for thread engagement and resist backing out; and 4) screws must be self-tapping or requiring minimal tapping. Delivery is required one week prior to the date of surgery for SPD sterilization purposes. Date of Material Required: 10 May 2017.

Depuy Synthes is the only manufacturer that can provide these salient characteristics mentioned above and with the most complete rod-screw system specifically designed for the treatment of minimally invasive surgery by offering up to 30 different sizes in rods and screws. Depuy Expedium system is the only option suitable for this situation.


This notice of intent is not a request for competitive proposals and no solicitation document exists for the requirement. Sources interested in responding to this notice are required to submit a capability statement that includes management and technical data and cost information, in sufficient detail and with convincing evidence that clearly demonstrates the capability to perform the required work. Capability statements shall not exceed 5 (8.5 x 11 inch) pages using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source purchase order.
