Construct Admin Facility, ATF
The project construction is for all new work, which, in accordance with 10 U.S.C 2805(c) is subject to a statutory limitation of $2 Million for all expenses, including utilities and administration costs (S&A). All of the otherwise acceptable bids exceeded the $2 Million statutory limit, and all but one also exceeded the 15% above the IGE allowable in UAI 5135.205-101.
Therefore, pursuant to FAR 14.404-1(c)(6) and (10), as implemented by DFARS 214.404-1, it is hereby determined that all otherwise acceptable bids received under subject solicitation are at unreasonable prices, and funding is not available to support an IFB to RFP conversion. The solicitation will be cancelled in its entirety.
