In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the U.S. Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to award a purchase order on a sole source basis to Scienta Omicron, Inc. for the following:

- Purchase of a new anode for NETLbs existing XPS system manufactured by Scienta Omicron. The current system is non-functional without the replacement anode.
- Upgrades of instrumentation hardware, computer control systems, and associated software on three (3) NETL-owned sensitive Scienta Omicron instruments.
- On-site service visit by Scienta Omicron technician to diagnose an electronic/mechanical noise issue being had with NETLbs Scienta Omicron LT STM in 84-118.

This is considered a sole source because, to the best of the NETLbs knowledge, based on market research conducted Scienta Omicron, Inc. is the sole U.S. provider of their Scienta Omicron instruments and the only known source that can provide the items, upgrades and service being requested. Scienta Omicron will not ensure the reliable or safe operation of their instrumentation unless their products, upgrades, and service technicians are used. No known potential alternate sources exist which could satisfy NETL's requirement.

This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 5:00 PM ET on September 2, 2017. Responses must be submitted in writing to the Contract Specialist via email at robert.mohn@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.

A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
