In accordance with Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, the U.S. Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to award a purchase order on a sole source basis to Thermo Electron North America LLC to purchase NETL's annual maintenance/service agreement. The performance period is from February 28, 2018 through February 27, 2020, plus up to two, 1-year option periods through February 27, 2022. This NETL-owned laboratory instrument (Dionex IC) contains unique commercially modified specifications in which only Thermo Electron North America, as the original equipment manufacturer (OEM), can maintain, service, and repair. To assure continued safe, reliable and satisfactory operation of the manufacturerbs instruments; maintenance, service, repair, replacement parts, software and etc. must be obtained from the OEM. This is considered a sole source because, to the best of the NETLbs knowledge based on market research conducted, Thermo Electron North America LLC is the sole, and the only vendor that can provide this exact match type of service to the Dionex IC instrument. No known potential alternate sources exist which could satisfy NETL's requirement.

This notice of intent is not a request for quote/proposal. Any interested party that believes it is capable of meeting the NETL requirement described herein may identify themselves and must provide evidence of their capability to fulfill the requirement being requested by 2:00 PM ET on February 27, 2019. Responses must be submitted in writing to the purchasing agent, Cynthia Panasiewicz, via email at Cynthia.Panasiewicz@netl.doe.gov no later than the time and date noted above. Telephone responses and requests will not be received.

A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
