The Naval Air Systems Command (NAVAIR) at Patuxent River, MD intends to award a Fixed Price Incentive Firm Target (FPIF) contract to The Raytheon Company, Space and Airborne Systems (SAS), 2000 East El Segundo Blvd., El Segundo, California.  This award will be on a sole source basis.  The contract will provide for the Low Rate Initial Production (LRIP) of up to four (4) LRIP I and up to eight (8) LRIP II shipsets (two pods per shipset), support equipment, spares, Gold Units for Operational Test Program Set (OTPS) development, and associated data.  The quantities identified herein are estimated and may be adjusted to reflect other such quantities as may be authorized and appropriated by Congress.

The statutory authority permitting other than full and open competition is 10 U.S.C. § 2304(c)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1: "Only one responsible source and no other supplies or services will satisfy agency requirements," and more specifically 10 U.S.C. § 2304(d)(1)(B) as implemented by FAR 6.302-1(a)(2)(ii): "Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in (A) Substantial duplication of cost to the Government that is not expected to be recovered in competition; or (B) Unacceptable delays in fulfilling the agency's requirements."

 

This is not a commercial buy; therefore, the Government does not intend to use the provisions of FAR Part 12 for this acquisition.  This synopsis is published for informational purposes only.  (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS).  Interested parties, however, may identify their interest and capability by responding to the requirement.  The Government will consider all capability information received prior to the closing date of this synopsis.  Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.  A determination by the Government not to compete based upon responses to this notice is solely within the discretion of the Government.  Expressions of interest in subcontracting must be addressed directly to Mr. Donald Ritter of Raytheon at (310) 647-0158.  There is no commitment by the Government to issue any solicitation, make an award, or to be responsible for any monies expended by any interested party before award of a contract for the efforts detailed above.  Information provided herein in no way binds the Government to solicit for or award a contract.  Telephone responses will not be accepted.
