Maintenance Agreement
NOTICE OF INTENT TO SOLE SOURCE:
The Centers for Disease Control and Prevention (CDC) announces its intention to solicit, negotiate and award a Firm-Fixed Price contract for laboratory maintenance on a sole source basis with Bio-Rad. The proposed action is to specifically procure the laboratory maintenance support for Bio-Rad equipment under NAICS Code 811219. The CDC Agency utilizes Bio-Rad proprietary laboratory equipment for various laboratory functions. Due to the highly specialized functions and capabilities of Bio-Rad equipment, the other technological producers do not possess the specific training and knowledge of proprietary software or access to Bio-Rad replacement parts to successfully repair, maintain, and update software on all Bio-Rad equipment. Bio-Rad is the only known source available in meeting the agency's critical mission requirements. Bio-Rad has access to the most updated software, supplies, parts, and trained service engineers to keep the equipment running at peak efficiency. Other providers cannot guarantee that a specific part, software version or a new feature on the equipment can be proved or serviced by their engineers. No provider other than Bio-Rad is capable of offering a maintenance contract involving CDC-owned Bio-Rad equipment that meets all of the technical requirements. CDC intends to negotiate this requirement with Bio-Rad under the authority of FAR 6.302-1(c) and HHSAR 306.302-1- Only One Responsible Source; and 41 U.S.C. 253(c)(1). This notice of intent is for informational purposes only. It is neither a request for proposals nor a solicitation for offers. This notice is not a request for competitive proposals. A determination to compete this procurement based on a response to this notice is solely within the discretion of the Government. Interested parties who believe they possess the capabilities to satisfy this requirement may submit a capability statement demonstrating their abilities to meet this requirement. All responses must be received by July 21, 2014 at 2:30PM, in accordance to FAR authority 5.203 (A) (1), Eastern Standard Time (EST).
