NOTICE TO OFFERORS, THIS ANNOUNCEMENT IS FOR MARKET RESEARCH PURPOSES ONLY. THIS IS NOT A SOLICITATION OR REQUEST FOR PROPOSAL AND DOES NOT OBLIGATE THE US GOVERNMENT TO ANY CONTRACT. RESPONSES TO THIS MARKET SURVEY SHALL BE FOR INFORMATIONAL PURPOSES ONLY. THE US GOVERNMENT WILL NOT REIMBURSE RESPONENTS FOR ANY COSTS INCURRED IN PREPERATION OF A RESPONSE TO THIS NOTICE.

Regional Contracting Command (RCC) - Kuwait (KU) is seeking eligible construction and related field contractors to furnish a wide range of repair, alteration and/or new construction work on various real property projects. The contractor shall provide all mobilization, quality assurance, safety, labor, materials, badging and supervision for their work force. The work shall include, but not limited to; carpentry, road repair, roofing, excavation, interior/exterior electrical work, plumbing, sheet metal, painting, demolition, concrete, masonry, welding, mechanical, and minor construction to include construction/assembly of modular type structures i.e., K-Spans and Relocatable Buildings.


The government intends to solicit and request competitive proposals for Multiple Award Task Order Contracts (MATOC) for construction and related projects in Kuwait; six (6) awards are anticipated, the Government reserves the right to award more or less. For award of the Basic MATOC, technical elevation factors will used in accordance with FAR 15.305 the Source Selection Evaluation Board (SSEB) Factors; (1) evaluate the SEED project for price, and (2) Technical, to include Past Performance (additional subfactors not yet available). All technical evaluation factors will be approximately equal to price. The fair opportunity process described in FAR 16.505(b) and Lowest Price Technically Acceptable (LPTA) will apply and be utilized to award Task Orders.


The total capacity is expected to be between $100M and $250M. Task Orders issued under this MATOC are anticipated to be between $2,000.00 and $5,000,000.00. Defense Base Act (DBA) Insurance, Payment and Performance Bonds will be required for all individual Task Orders unless deemed impractical. Task Orders will be Firm-Fixed Price (FFP). At least one Seed Project is anticipated, though the Government reserves the right to award without a Seed Project. For purposes of reporting business size, the applicable North American Industry Classification Systems (NAICS) Code for this requirement is 238990, all other Specialty Trades with a size standard of $15M in average annual receipts and the Product Service Code is Z199, Maintain, Repair and Alteration - Miscellaneous Buildings.


NOTE: The following are requirements for doing business in the country of Kuwait: Common business forms under the Kuwaiti Commercial Companies Law are the Limited Liability Company (WLL), Closed-shareholding Company (KSCC), Public-shareholding Company (KSC), Joint Liability Company (JLC), Limited Partnership (LP), and Joint Venture (JV). In your response to this notice indicate your company type. Article (23) of the Kuwaiti Commercial Code states that non-Kuwaiti citizens may not pursue commercial activities in Kuwait, unless they have a Kuwaiti citizen as a partner. Article (24) states that no foreign company may establish a branch in Kuwait unless it has a Kuwaiti citizen as an agent. Consult a legal professional and a Kuwaiti sponsor (which acts as a guarantor for individuals or organizations) prior to responding to this notice.


The period of performance will be no more than five (5) years, including Options.

All responses to this Source Sought announcement will be submitted by March 31, 2017 at 1830 (6:30 PM local Kuwait time). Number of awards and dollar thresholds are subject to change.
