The Naval Air Warfare Center - Aircraft Division Lakehurst, NJ, under the authority of 10 USC 2304(c)(1), FAR 6.302-1, intends to award a Firm-Fixed Price contract, on a sole-source basis, to BAE Systems Controls Inc., San Diego, CA (CAGE: 12436) for the manufacture of the Loop Resistance Tester P/N 906-10246-3.  This procurement is required to support the P-8A aircraft.  The quantities fill deficits for the United States Navy and a future option for additional United States Navy requirements.  The requirement is for a base quantity of eleven (11) each of the Loop Resistance Testers and an option quantity of twenty (20) Loop Resistance Testers.  The Loop Resistance Tester was designed by BAE Systems at their own expense and tested to meet specifications for maintenance of the 737 and P-8A aircraft.  BAE Systems owns all proprietary rights to the engineering data and detailed product drawings.  BAE Systems is the only manufacturer with the unique technical expertise to supply this item.  An adequate purchase description or other information suitable to solicit by full and open competition has not been developed because the Government does not have sufficient engineering data or drawings to organically design the above item and enable a competitive procurement.  BAE Systems as the Original Equipment Manufacturer (OEM) is the only source that is capable of providing the above item to the same form, fit and function that is compatible with the existing configurations.  THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.  However, the Government will consider all responses received within fifteen days after the date of publication of this synopsis.  Registration in the System for Award Management (SAM) (https://www.sam.gov) is mandatory for consideration.  A determination by the Government not to open the requirement to competition based on the responses to this notice will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.  Information provided herein is subject to change and in no way binds the Government to solicit an award of a contract.
