The United States Department of Transportation's Maritime Administration (MARAD) requires contracted legal services pertaining to the construction of the new National Security Multi-Mission Vessel (NSMV) and/or the acquisition and conversion of an existing vessel into a training vessel in a shipyard within the United States. In contracting for the NSMV MARAD plans to enter into a contract with a private United States commercial vessel operating entity (CVOE) that has constructed a vessel within the United States within the last five years.
Legal services contractor shall furnish all personnel, labor, equipment, and supervision to provide, legal services ordered by the Government under the contract, including researching, drafting, document review, and advisory services on any issues arising out of or relating to the construction and delivery of the NSMV. Such services may include, but are not limited to, reviewing NSMV related documents such as the contractual agreement with the CVOE and the ship construction contract between the CVOE and the shipyard constructing the vessel; advising Federal officials in the handling of NSMV related negotiations; and advising the legal counsel of MARAD on various issues arising out of or relating to the construction of the NSMV, including, but not limited to, schedule delays, production problems, design defects, shipyard production issues, weather delays, cost and delay increases, change orders, warranty issues following delivery of the NSMV, other disputes, and such other issues as may be determined by MARAD's Office of Chief Counsel.
Services will primarily be provided by a Lead Attorney with some assistance by an associate if desired. The lead attorney shall have experience in the past ten years providing legal advice for the construction of a commercial vessel in a shipyard in the United States that is eligible to receive a certificate of documentation and a coastwise endorsement under chapter 121 of title 46, United States Code, and be knowledgeable about all applicable United States Coast Guard, Maritime Administration, and other Federal government requirements; have experience using standard commercial ship construction and related contract forms and handling commercial shipyard construction related issues; be knowledgeable about ship construction production scheduling and all Federal and State laws applicable to the construction of vessels; and be familiar with admiralty law, the Jones Act, and Federal government procurement laws and regulations
