The following is contemplated as described by this RFP:
Governmental immunity provides protection from certain exposures including claims for monetary damages in all instances when performing discretionary duties in good faith and within the scope of the individuals authority to act. Coverage will not be needed for those exposures where government immunity is applicable. Among them are:
a.Under certain circumstances, public servants, defined as an employee, member of the governing board or any other officer of a state agency, institution or department (including former), are not personally liable for damages in excess of $100,000 arising from personal injury, death or deprivation of a right, privilege or immunity. The State of Texas will indemnify a member of a governing board or any other officer of a state agency up to $100,000 per person and $300,000 per occurrence for damages caused by ordinary neglect or the deprivation of a right, privilege or immunity; and $10,000 for property damage protected by state or federal law
b.In the case of some federal claims, neither the States immunity nor the liability limitation under the Texas Tort Claims Act will be applicable.
