Notice of NIST's Intent to Negotiate on Sole Source Basis for SystemVue software upgrades and support
The National Institute of Standards and Technology (NIST) supporting The National Telecommunications and Information Administration (NTIA) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b) (1), with Keysight Technologies, PO Box 4026, Englewood CO 8055-4026 to purchase SystemVue software upgrades and support for previously purchased software licenses.
The sole source justification is based on the following: NTIA requires software upgrades and support for previously purchased software that supports the use of radio system software used to determine interference protection criteria for radio systems. No other vendor can provide the upgrades and support to the proprietary and copywritten Keysight software.
Market research has shown that Keysight Technologies is the only source reasonably available to provide the items meeting the requirements of the (below) Statement of Work.
The resulting purchase order will be a Firm Fixed Price purchase order. The NAICS Code is 511210 with a size standard of $38.5M employees.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested parties who regard themselves as capable of fulfilling these requirements are invited to submit responses to the Government for consideration. Responses received by 10:00 AM ET on Monday, March 5, 2018, will be considered by the Government.
A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.

SCOPE OF WORK
Technical specifications: The software upgrades and support are for 2 licenses of SystemVue radio simulation software produced by Keysight Technologies. The software upgrades and support will provide major and minor software upgrades as well as technical support from SystemVue software experts via telephone and email.
