USDA, Rural Development seeks to retain a private attorney or law firm (hereinafter the “contractor”) to provide legal services for Judicial foreclosures, bankruptcies, and/or actions to recover possession related to Section 502 Single Family Housing debts to the United States of America, United States Department of Agriculture, Rural Development in the State of Arkansas.

The resulting acquisition vehicle will be a multiple award Blanket Purchase Agreement. The contractor will provide all legal and related services, including title search updates, in connection with each assigned case to complete the foreclosure.

This is a notice that this Blanket Purchase Agreement is a total set aside for small business concern. Only quotes submitted by small business concerns will be accepted by the Government. Any quote that is submitted by a contractor that is not a small business concern will not be considered for award.

 All litigation, enforcement, and collection actions on the part of the Contractor shall be in compliance with all Federal, State, and local statutes, regulations and ethical standards that apply to the liquidation of loan security and the collection of debts. These include but are not limited to:

The Privacy Act of 1974, as amended (5 U.S.C. 552a); the Fair Debt Collection Practices Act (15 U.S. C. 1692 et seq.); the Debt Collection Act of 1982, as amended (P.L. 97-365); the American Bar Association Model Rules of Professional Responsibility (1983); the Debt Collection Improvement Act of 1996; and AB 2246, Disposal Requirements for Consumer Records held by Title Companies (Jan. 2001).  The Contractor performing legal services must be duly licensed to practice law and in good standings with the Arkansas Supreme Court. Contractor must provide proof thereof. Within 30 days from acceptance of this agreement, the Contractor shall present evidence of professional liability insurance coverage for errors and omissions in accordance with local and state government requirements for each individual in the firm who will have access to proceeds from the legal actions under this agreement. These statutes and standards, as well as other applicable Federal and State laws and regulations pertaining to the Government as a whole are incorporated by reference into this Agreement. Violation of applicable law, regulation or ethical standards shall be cause for termination.  The solicitation will be available only on the Federal Business Opportunities website, www.fbo.gov, and is anticipated to be released on or about January 8, 2018. Amendments to the solicitation, if any, issued prior to the receipt of proposals will also be posted on www.fbo.gov. Interested parties are responsible for monitoring this site for access to the solicitation. All responsible sources meeting the eligibility requirements may submit a proposal which will be considered by the Government. It is highly recommended that, prior to submitting a proposal, interested parties obtain a Dun and Bradstreet (DUNS) number and register in the System for Award Management (SAM), www.sam.gov, as these requirements are mandatory for any firm selected for a contract award.
