Explosion Proof Articulating Boom Lifts (Manlifts)
Additional Information/Notes
B.1 GENERAL: The quantities identified in the schedule represent the Government's Best Estimated Quantities (BEQs) of aerial lifts modified to meet Explosion Proof (EX) Articulating Boom Lift specifications, and do not represent a minimum or maximum quantity. Failure of the Government to order the BEQ quantity will not entitle the contractor to an equitable adjustment under the contract. In accordance with the clause in Section I of this contract, DFARS 252.216-7006, delivery orders may be issued hereunder for an ordering period of two (2) years from the effective date of the contract against the contract line item number CLINs included in the schedule. Orders issued hereunder shall utilize the CLINs representing the period in effect at the time of order award for purposes of pricing.
B.2 SPECIAL STANDARDS OF RESPONSIBILITY: Please note the "Special Standards of Responsibility" listed on page 40, section I of this solicitation, under the clause FAR 52.212-2 Evaluation--Commercial Items.
B.3 CONTRACT TYPE: This is a Requirements type contract as contemplated at FAR 16.503. This contract utilizes FFP Contract Line Item (CLINs).
B.4 ORDERING PERIOD: In accordance with the Clause in Section I of this contract, DFARS 252.216-7006 Ordering, delivery orders may be issued hereunder for a period of two (2) years from the effective date of the contract against the contract line item numbers (CLINs) included in the schedule. Boom Lift Delivery shall begin no later than twenty two (22) weeks after the effective date of each delivery order, with a minimum quantity of all lifts (45, 60, and 80) to be two (2) perweek until the order is fully delivered. The contract ordering periods associated with each CLINs series are defined as follows:
Ordering Period I: CLINs 0001-0004 Ordering Period II: CLINs 1001-1004
Contract Award through twelve (12) months ARO Expiration of first ordering period through twelve (12) months ARO
Ordering Period II: CLINs 1001-1004
Contract Award through twelve (12) months ARO Expiration of first ordering period through twelve (12) months ARO
B.5 GUARANTEED VALUE: The quantities of supplies or services specified in this schedule are for estimation purposes only. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated" or "maximum" in the schedule, that fact shall not constitute the basis of an equitable price adjustment or claim. This contract is not a guarantee of work to be performed, but, rather a promise that if these requirements do no generate, the USG will award delivery orders against this contract to fulfill those requirements.
