The Office of Acquisition and Agreements Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole source basis with JEOL, USA, Inc., of Peabody, MA, to disassemble and relocate a NIST-owned JEOL, USA, Model 3010 Transmission Electron Microscope.

NIST/MML has a requirement to relocate a NIST-owned JEOL USA, Inc., Model 3010 Transmission Electron Microscope (TEM) to enhance its performance capabilities. The Contractor shall disassemble the TEM, move it to another location with the same room on the NIST campus in Gaithersburg, MD, reassemble the TEM, and test the instrument to ensure that it is functioning in accordance with manufacturer's specifications.


Sole source determination is based on the following:
The JEM3010 is currently covered by a full service maintenance agreement under NIST contract number SB1341-15-SE-0337. In the statement of work of the aforementioned service contract reads "The JEM-3010 is considered a legacy unit. An inspection and repair service will be scheduled to determine future coverage. Future coverage is offered at the sole discretion of JEOL." JEOL has identified the JEM3010 as a legacy unit as it had been dropped from service for some time. JEOL has required NIST to have the instrument evaluated prior to re-initiating maintenance coverage. JEOL has agreed to cover the instrument under the aforementioned contract. If a source other than JEOL were to disassemble and relocate the equipment, JEOL would discontinue maintenance service for the TEM. Continuity of service is required for the TEM.


The North American Industry Classification System (NAICS) code for this acquisition is 488999 and the small business size standard is $7.5 M.


No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by August 5, 2016, will be considered by the Government.


A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
