The Commodity Futures Trading Commission (CFTC) intends to award a purchase order to CipherTrace, Incorporated on a sole source basis for two (2) licenses to access their proprietary CT AML Console cloud based solution for up to ten (10) CFTC staff. The purchase order will be for one (1) year of access. CFTC currently uses another solution as an investigation tool for tracing Bitcoin transactions, leveraging a proprietary database of meta-data associated with Bitcoin transactions. CFTC requires the second differing solution to provide support as a second confirmation source of its investigations. This procurement action is being conducted under FAR 13.106-1(b)(1)(i) "For purchases not exceeding the simplified acquisition threshold, (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization)."

This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the response date and time identified in this synopsis. Written responses must include sufficient information to establish capability to fulfill the requirement. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source contract described in this notice, and such determination shall be made at the sole discretion of CFTC.
