DESCRIPTION: Purchase of BMC Remedy Force Service Desk Software Annual Maintenance Support Renewal.

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a "Brand Name - Items Peculiar to One Manufacturer" fixed price quotation is requested and a written solicitation will not be issued. The solicitation number is NAMA-17-Q-0141 and is issued as a Request for Quote (RFQ). Quotations furnished are not offers. This request does not commit the Government to pay any costs incurred in the preparation or the submission of this quotation or to contract for supplies or services. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95 effective January 13, 2017. This is a "Brand Name" requirement in accordance with FAR 11.105 in addition to the brand name, a general description of those salient physical, functional, or performance characteristics of the brand name item must meet to be acceptable for award, under NAICS 511210, Software Publishers. The resulting purchase order will be a firm-fixed price purchase order and will be issued to the Contractor whose conforming quotation in response to the RFQ will be most advantageous to the Government.

The following clauses and provisions are incorporated and are to remain in full force in any resultant fixed price contract and associated delivery order:


FAR 52.212-1, Instructions to Offerors-Commercial Items (Oct 2015) Delete Paragraph h, Multiple Awards;


EVALUATION -The Government reserves the right to award without discussions. Award will be made to the offeror whose proposal in response to the RFQ will be most advantageous to the Government. Best value for this award will be obtained through a lowest price technically acceptable evaluation. For evaluation purposes, the fixed price for each Contract Line Item Number (CLIN) will be determined by multiplying the fixed unit price by the maximum quantity of units, and the total fixed price will be determined by summing the fixed price of all CLINs .


FAR 52.212-3, Offeror Representations and Certifications-Commercial Items (Jul 2016) - offerors shall complete only paragraph (b) of this provision if the vendor has completed the annual representations and certificates electronically at http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the SAM website, the offeror shall complete only paragraphs (c) through (o) of this provision--a copy of the provisions can be found at http://www.arnet.gov/far/;
