Pursuant to Federal Acquisition Regulation (FAR) 12.603(a), the Contracting Officer is issuing a solicitation for the acquisition of hay to support daily feeding of wild horses and burros (WH&B) at the Palomino Valley, Nevada, WH&B Facility.
(i) This is a solicitation for the acquisition of commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued.

(ii) Solicitation Number 140L0619B0004 is being issued as an Invitation for Bid (IFB). This solicitation will utilize the policies contained in FAR Part 14, Sealed Bidding in conjunction with the policies and procedures for solicitation evaluation and award prescribed in FAR Part 12, Acquisition of Commercial Items, as appropriate for this acquisition.

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2019-02 effective June 5, 2019.

(iv) This solicitation is being issued as a Total Small Business Set Aside. The NAICS associated with this solicitation is 111940, Hay Farming, with a size standard of $750,000.00.

(v) See the attached Specifications Document for detailed requirements (Attachment 1). The pricing sheet to be completed and returned with your bid is provided as a separate document (Attachment 2).

(vi) The items to be acquired through this solicitation are hay for the Palomino Valley, Nevada, WH&B Facility.

(vii) Delivery location is detailed in the attached Specifications document (Attachment 1).

(viii) FAR Provision 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. Potential bidders shall read and comply with all of the requirements. Attachment 5 provides additional instructions to offeror/bidders.

(ix) This acquisition is being solicited using FAR Part 14, Sealed Bidding. The basis of award will be Lowest Priced Bid. The award will be made to the small business who is a responsive, responsible bidder whose bid, conforming to this invitation for bid (IFB) that is the most advantageous to the Government, considering the evaluated price. The evaluated price will be the total bid price.

To be eligible for award, the bidder must be a small business deemed responsible in accordance with FAR 9.104, provide all documentation/information required in this solicitation; meet all requirements of the solicitation and conform to all required terms and conditions. Failure to comply with the terms and conditions of the solicitation may result in the bidder being ineligible for award.

(x) Offerors/Bidders shall ensure that their Offeror Representations and Certifications - Commercial Items (FAR Provision 52.212-3) are updated in SAM. If an offeror/bidder does not have an active SAM registration they shall complete FAR clause 52.212-3 and include it with their bid submission.

(xi) FAR Clause 52.212-4, Contract Terms and Conditions - Commercial Items applies to this acquisition, see Attachment 3.

(xii) FAR Clause 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, applies to this acquisition. See Attachment 3, FAR Clause 52.212-5 for additional information.

(xiii) Additional clauses that apply to this acquisition are provided at Attachment 3. These clauses will be incorporated into the successful offeror/bidders' contract award. Additional provisions that apply to this acquisition are provided at Attachment 4. These provisions are incorporated into this solicitation, but will not be incorporated into the successful offeror/bidders' contract award.

(xiv) The Defense Priorities and Allocations System (DPAS) does not apply to this acquisition.

(xv) Bids are due no later than Thursday, August 15, 2019 @ 10:00 a.m. MT. Bids shall be submitted in accordance with the instructions in Attachment 5. Bid opening will take place on Thursday, August 15, 2019 @ 10:00 a.m. MT. See Attachment 5 for more details.
