Naval Surface Warfare Center, Crane Division, Crane, IN intends to award a sole-source contract to NAMMO RAUFOSS AS, Raufoss, Norway for MK314 ammunition, 40mm Programmable High Explosive Dual Purpose (P-HEDP) High Velocity Grenade. This effort will be conducted on a sole-source basis in accordance with the statutory authority 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1. The resulting award has a 5-year ordering period, with an addition of five, one-year option CLINs, for a potential ten year contract award, with a minimum contract quantity of 1,895 rounds and maximum contract value of $35,000,000. The Government's delivery requirement is 13,000 rounds due 90 days after receipt of delivery order. The basis for restricting competition is the Government does not own the data rights to this item and does not plan to purchase the data rights from Nammo. Award to any other source would result in substantial duplicate costs, testing, procurement, evaluation, and certification costs which is not expected to be recovered through competition.


This acquisition is under North American Industry Classification System code (NAICS) 332993 - Ammunition (except Small Arms) Manufacturing. Delivery terms are FOB Destination. Inspection and Acceptance will be performed at Source by a DCMA representative and/or NSWC Crane representative.


This effort will be conducted on a sole-source basis in accordance with the statutory authority 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, ‘Only one responsible source and no other supplies or services will satisfy agency requirements." The basis for restricting competition is the fuze design (MK444) used in the MK314 cartridge was exclusively developed by NAMMO and contains unique features that are required for use in the MK47 Advanced Lightweight Grenade Launcher (ALGL). The MK444 fuze was specifically designed for the MK47 ALGL which uses an AN/PWG-1 grenade launcher sight providing full weapon system capability. The programming interface between the AN/PWG-1 sight and MK444 fuze is proprietary to NAMMO. The full capability of the MK314 is only available when employed with the MK47 ALGL. Award to any other source would result in substantial duplication of testing, procurement, evaluation, and certification costs, which is not expected to be recovered through competition. Since this is a sole source procurement, a solicitation will not be posted to the internet.


The proposed action is for supplies which the Government intends to solicit and negotiate with only one source under authority of FAR 6.302-1. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for proposals. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received in response to this synopsis will normally not be considered solely for the purpose of determining whether to conduct a competitive procurement.
